Terms & Conditions

These terms explain the basis on which Trevado Studio provides website design, development and related digital services.

Specific project requirements, pricing and deliverables may also be agreed separately in writing before work begins.

1. About Trevado Studio

Trevado Studio is an independent digital studio based in Cardiff, South Wales.

We provide services including website design, website development, ecommerce, booking integrations, payment integrations, search optimisation and related digital services.

2. Project agreements

Before work begins, we will normally agree the main requirements of the project with the client.

This may include:

  • The pages or features to be created
  • The functionality required
  • Third-party integrations
  • The project price
  • Payment arrangements
  • An estimated project timescale
  • The number of revision rounds included

Written confirmation by email or another agreed communication method may form part of the project agreement.

3. Quotations and pricing

Prices displayed on the Trevado Studio website are indicative package prices unless expressly stated otherwise.

The final price may depend on the requirements, complexity and functionality of the individual project.

Any additional work outside the agreed project scope may be quoted separately.

4. Founding client pricing

Promotional or founding-client prices may be offered for a limited period or to a limited number of clients.

Availability of promotional pricing is not guaranteed until a project has been accepted by Trevado Studio and the required initial payment has been received.

Trevado Studio may withdraw or change promotional pricing for future projects at any time.

5. Payments

Payment arrangements will be confirmed before work begins.

Trevado Studio may require an initial payment or deposit before beginning a project, with the remaining balance payable at an agreed stage or before final handover.

Unless otherwise agreed in writing, the completed website or final project files may be withheld until all amounts due for the project have been paid in full.

6. Client responsibilities

The client is responsible for providing the information, content and access reasonably required to complete the project.

This may include:

  • Business information
  • Text and service information
  • Images and branding materials
  • Domain or hosting access
  • Access to relevant third-party services
  • Timely feedback and approvals

Delays in receiving required information, content, access or feedback may affect the project timescale.

7. Client content

The client is responsible for ensuring that content supplied to Trevado Studio can lawfully be used.

This includes text, photographs, logos, graphics, trademarks, videos and other materials supplied for inclusion in the project.

The client confirms that they own the relevant rights or have appropriate permission to use materials they provide to us.

8. Revisions

The number of revision rounds included in a project will depend on the package or project agreement.

A revision means a reasonable amendment to work already produced within the agreed project scope.

Major changes in direction, new pages, additional functionality or work outside the original scope may require an additional charge.

9. Project timescales

Any project completion date or timescale provided by Trevado Studio is an estimate unless expressly agreed otherwise in writing.

Timescales may be affected by project complexity, client response times, third-party services or circumstances reasonably outside our control.

We will make reasonable efforts to communicate significant changes to an expected project timescale.

10. Third-party services

Websites may rely on third-party products or services.

These may include:

  • Hosting providers
  • Domain registrars
  • Booking platforms
  • Payment processors
  • Ecommerce platforms
  • Email providers
  • Analytics services
  • Fonts, plugins, APIs or software services

Third-party services are subject to their own terms, pricing, availability and policies.

Trevado Studio does not control third-party services and cannot guarantee that they will remain continuously available, unchanged or free of charge.

11. Domains, hosting and ongoing costs

Unless specifically included in a project agreement, domain registration, hosting, email, subscriptions, licences and other third-party charges are separate from the website development price.

We will aim to make known ongoing costs clear where they are reasonably identifiable during the project.

The client is responsible for maintaining services registered in their name after handover.

12. Website ownership

Unless otherwise agreed in writing, ownership of the final bespoke website deliverables created specifically for the client will transfer after all agreed project payments have been received.

This does not transfer ownership of third-party software, services, fonts, libraries, platforms, plugins, stock assets or other materials that are subject to separate licences or ownership rights.

Trevado Studio retains ownership of its own pre-existing tools, methods, reusable components, knowledge and intellectual property that were not created exclusively for the individual client.

13. Portfolio use

Unless the client asks us not to, Trevado Studio may display completed work as an example of our services, including on our website, portfolio and business promotional materials.

We will not intentionally disclose confidential information when doing so.

14. Search engine optimisation

Where SEO services or SEO foundations are included, Trevado Studio will use reasonable practices intended to improve the website's search visibility.

Search engine rankings are controlled by third parties such as search engines and cannot be guaranteed.

We therefore do not guarantee any particular ranking, level of traffic, number of enquiries or commercial result from SEO work.

15. Website performance and results

Trevado Studio does not guarantee that a website will generate a particular number of enquiries, bookings, sales, visitors or amount of revenue.

Website performance can depend on many factors outside our control, including the client's market, pricing, reputation, advertising, competition and customer demand.

16. Testing and launch

We will take reasonable steps to test websites and functionality before launch.

The client will normally have an opportunity to review the website before final approval or launch.

Minor issues discovered shortly after launch that relate directly to the agreed development work should be reported to Trevado Studio as soon as reasonably possible.

17. Changes after completion

Unless ongoing maintenance has been specifically agreed, work requested after the project has been completed or handed over may be treated as additional work and quoted separately.

Trevado Studio is not responsible for faults caused by changes made by the client or another third party after handover.

18. Cancellation

If a client wishes to cancel a project after work has started, they should contact Trevado Studio as soon as possible.

The client may remain responsible for payment for work already completed, committed third-party costs and other amounts properly due under the project agreement.

Any refund or outstanding balance will depend on the circumstances, work completed and the payment terms agreed for the project.

19. Suspension or termination

Trevado Studio may suspend or terminate work where there is a serious breach of the project agreement, including significant non-payment or unlawful use of our services.

Where reasonably possible, we will attempt to communicate and resolve the issue before terminating a project.

20. Confidential information

Both parties should take reasonable care with confidential business information received during a project and should not disclose it unnecessarily to third parties.

This does not prevent disclosure where required by law or where information is already legitimately public.

21. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

Subject to applicable law, Trevado Studio will not be responsible for indirect or consequential losses arising from matters outside the reasonable scope of the services we agreed to provide.

We are not responsible for failures, outages, changes or losses caused by third-party platforms or services outside our reasonable control.

22. Events outside our control

Trevado Studio will not be responsible for delays or failures caused by events reasonably outside our control, including major internet outages, third-party platform failures, natural events or other significant disruptions.

23. Changes to these terms

Trevado Studio may update these website terms from time to time.

Changes will not retrospectively alter separately agreed project terms unless both parties agree to the change.

24. Governing law

These terms are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, unless applicable law requires otherwise.
